ICSA Statement on Illegal Nicotine-Pouch Sales

We've reviewed the recent CBC report on the illegal sale of nicotine pouches.

The Independent Convenience Stores Alliance (ICSA) has reviewed the recent CBC report on the illegal sale of nicotine pouches. We want to be absolutely clear: we have zero tolerance for any store owner who sells unauthorized products or breaks the law. These actions undermine the reputation of thousands of responsible independent retailers across Canada.

We fully support stronger enforcement and more frequent inspections, and we encourage governments to work directly with industry associations to provide clearer education and compliance guidance—particularly for the many independent stores operated by new Canadians who may not fully understand rapidly changing regulations.

At the same time, this situation reflects a broader problem: when government unnecessarily restricts access to regulated nicotine-cessation products, demand shifts to the black market. Unscrupulous traffickers are openly approaching retailers, pushing unregulated products without any regard for public health or the law. This harms both consumers and legitimate store owners.

The ICSA believes regulated nicotine pouches—sold responsibly with age verification—should be treated similarly to other long-accepted cessation products like gum and lozenges. Allowing responsible retailers to sell approved products helps adult smokers quit while reducing the influence of illegal sellers.
